2. These terms
These terms and conditions govern your use of this website. They also set out the general basis on which we provide our services. They do not replace the written terms of engagement issued with your quotation, which set out the detailed terms for the specific survey or service you instruct. If there is any conflict between these terms and your terms of engagement, the terms of engagement take precedence.
By using this website you accept these terms. If you do not accept them, please do not use the site.
3. Using this website
You may use this website for lawful purposes only. You must not use it in any way that breaches any applicable law or regulation, or that is fraudulent or harmful. You must not attempt to gain unauthorised access to the site, the server on which it is stored, or any server, computer or database connected to it.
We may suspend, withdraw or restrict all or part of the site without notice. We do not guarantee that the site, or any content on it, will always be available or uninterrupted.
4. Intellectual property
We own or are licensed to use all intellectual property rights in this website and in the material published on it, including text, photographs, illustrations and our name and logo. These works are protected by copyright and other laws.
You may print or download extracts for your own personal, non-commercial use. You must not modify copies of any material, use any illustrations or photographs separately from the accompanying text, or use any part of the content for commercial purposes without a licence from us.

The content on this website is provided for general information only. It is not advice on which you should rely, and it does not take account of the circumstances of any particular property. Professional advice is given only in a report or written advice prepared for you following an inspection or instruction.
We take reasonable care to keep the information on this site accurate and up to date, but we make no representation or warranty that it is accurate, complete or current.

Where this website links to other sites or resources provided by third parties, those links are provided for your information only. We have no control over the contents of those sites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them.
7. Our services
We provide residential and commercial surveying services, including RICS Home Survey Level 1, Level 2 and Level 3 reports, commercial building surveys, schedules of condition, snagging reports, damp investigations, drone inspections and single defect reports.
Each service has a defined scope. The scope, and the limitations that apply to it, are described on the relevant service page and in the terms of engagement issued with your quotation. An inspection does not cover parts of a property that are not reasonably accessible, and we do not carry out opening up or specialist testing unless separately agreed in writing.
Any additional service not covered by your terms of engagement must be agreed separately in writing.
8. Quotations and fees
Enquiries made through this website, by telephone or by email are not a binding contract. A contract is formed only when we issue terms of engagement for the service and you confirm your instructions.
Fees are quoted individually for each property and instruction, and are confirmed in writing before work begins. Unless stated otherwise, a quotation is valid for the period stated on it.
9. Payment
Payment terms are set out in your terms of engagement. Unless we agree otherwise in writing, our fee is payable before the report is released.

10. Cancelling your instruction
Where you are a consumer and you instruct us at a distance or away from our premises, you normally have a statutory right to cancel within 14 days of entering into the contract. If you ask us to begin work during that period and then cancel, we may charge you for the work reasonably carried out up to the point of cancellation.
If you need to postpone or cancel an inspection, please tell us as soon as possible. Charges for late cancellation, where they apply, are set out in your terms of engagement.
Nothing in these terms affects your statutory rights.
11. Your report
A report is prepared for the client named in it and for the stated purpose. It reflects the condition of the property on the date of inspection.
We cannot accept responsibility to anyone other than the named client, and a report may not be relied on by a third party unless we have agreed to that in writing. If you decide not to act on the advice in a report, you do so at your own risk.
12. Our liability
Our professional liability, including any limit on the amount of that liability, is set out in the terms of engagement for the service you instruct. We maintain professional indemnity insurance as required by RICS.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.
If you are a consumer, we are not liable for business losses. If you are a business, we are not liable for loss of profit, loss of business or any indirect or consequential loss.
We do not accept liability for loss or damage caused by a virus or other technologically harmful material that may infect your equipment through your use of this website.
13. Complaints
We operate a formal complaints handling procedure and will provide a copy on request. If you are unhappy with any part of our service, please contact us in the first instance on 01603 213362 or at enquiries@vollersurveyingservices.co.uk so that we can try to put things right.
Where a complaint cannot be resolved with us, it may be referred to the independent redress scheme identified in our complaints handling procedure.
14. Regulation
We are regulated by RICS and our surveyors work to RICS professional standards. Where a service is provided under an RICS standard, the relevant standard is identified in the report or in your terms of engagement.
15. Your privacy
We handle personal data in accordance with UK data protection law. We use the information you give us to prepare quotations, carry out instructions, and administer your account. Details of how we collect and use personal data are set out in our privacy policy.
16. Changes to these terms
We may amend these terms from time to time. The version that applies is the version published on this page when you use the site. Please check this page to see whether it has changed. The terms of engagement for an instruction are fixed at the date of that instruction and are not affected by later changes to this page.
17. Governing law
These terms, and any dispute or claim arising out of them or their subject matter, are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident in Scotland or Northern Ireland you may also bring proceedings in your local courts.
